TERMS & CONDITIONS
SPU is a resource for professional photographers who want to hone their skills andincrease their business profitability. By becoming a member of SPU, you agree to be bound by the following terms & conditions of use.
SPU reserves the right to amend these terms at any time.
Member's account may be terminated without notice at any time for failure to abide by any of these Terms.
MEMBERSHIP
Membership is limited to individuals over the age of 18.
Membership is not transferable.
Members are responsible for keeping their password secure and may not use another member's account.
Member must use either their real name or legal business name on their profile. Anonymous memberships are not allowed.
SPU reserves the right to accept or reject membership at its sole discretion.
By joining SPU, members acknowledge that SPU is a subscription-only service.
Members may terminate their membership at any time.
Member is responsible for all of the content he or she uploads, shares or copies with SPU.
Members may not use the services provided by SPU for unlawful or prohibited purposessuch as:
- Content that is patently offensive, or that promotes racism, bigotry, hatred or physical harm of any kind against any group, individual.
- Content that attacks, harasses or advocates harassment of another person.
- Content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing or "spamming."
- Content that promotes information that is false or misleading, or that promotes illegal activities
- Content that promotes the illegal or unauthorized copying of another person's copyrighted work, for example, providing pirated computer programs or links tosuch programs, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files.
- Content that contains restricted or password-only access pages or hidden pages or images not linked to or from another accessible page.
- Content that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.
- Content that depicts pornography of any sort.
- Content that provides instructional information about illegal activities such as making or buying illegal weapons, violating the privacy of another, or providing or creating computer viruses;
- Content that solicits passwords or personal identifying information for commercial or unlawful purposes from other members.
- Content that involves commercial activities and/or sales without the prior expresswritten consent of Sandy Puc' University. This prohibition includes, but isnot limited to, contests, sweepstakes, barter, advertising, or pyramid schemes.
- Content or conduct that is abusive, threatening, obscene, defamatory, or libelous.
Member must not transmit any virus, code, worm, data or any other file of a destructive nature.
If members violate these terms or otherwise disrupts the SPU site, the member is subject to detention, suspension or expulsion from SPU without prior notice and without refund. Notice of expulsion from SPU will be sent to email addressprovided by the member at registration.
SERVICES
SPU strives to maintain web presence 24 hours a day, however SPU may occasionallybe interrupted for upgrades or disrupted for unforeseen technical difficulties. SPU will not be liable for any disruption of the service for any reason.
SPU Office hours are Monday through Friday 8:00 a.m. - 5:00 p.m.
By submitting images or sharing articles and testimonials with SPU, members grant SPU a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such submissions in connection withthe SPU Website and SPU business, including without limitation for promoting and redistributing part or all of the SPU Website (and derivative works thereof) in any media formats and through any media channels. Member understands and agrees that SPU may retain server copies of submissions thathave been removed or deleted.
Member hereby grants each user of SPU a perpetual, irrevocable, and non-exclusive license to access member's submissions through the SPU website, and to use, reproduce, distribute, display and perform such submissions.
PRIVACYPOLICY
SPU is committed to safeguarding member's privacy.
Member phone personal information are not posted online, and are only retained by SPU for contact purposes.
OTHERLEGAL MATTERS
These terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any dispute between Member and SPU shall be adjudicated in courts within the state of Colorado.
All trademark brands and service names used in this service which identify SPU areproprietary marks of SPU.
SPU may provide external links to other websites, but SPU does not endorse or assume responsibility for the content or availability of any other website.
Member agrees to indemnify and hold SPU, its subsidiaries, affiliates, officers, agents, partners and employees harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to, or arising out of, member's use of the SPU service in violation of these terms.
FEES
The right of access granted under these terms is effective only upon payment of the subscription fees, which are non-refundable, other than as expressly provided herein.
The monthly subscription automatically renews for a fee of $24.95 per month on the first of each month.
SPU will charge the subscription fees to member's credit card, every calendar month unless member cancels the subscription as set forth herein. The Per Calendar Month subscription shall renew automatically, and SPU will charge the monthly subscription fees, on the first each corresponding month.
The monthly subscription may be canceled by member by notifying SPU in an e-mail sent to admin@sandysworlduniversity.com,but any fees paid are non refundable.
SPU may increase subscription fees at any time and for any reason, and suchincreased fees shall be applicable to any new subscription or re-subscription.
REFUND POLICY
The SPU monthly educational service (access to all the information on the website, with options to download/purchase additional materials) is not refundable after payment has been made. CDs and DVDs may be returned for a full refund if they have not been opened and are in the original packing.
RETURNPOLICY
If a CD or DVD is not working, customers may call customer service for tech supportor authorization to return the product for a functioning disc.
CANCELLATIONPOLICY
The SPU service may be cancelled in advance of the next month's edition if a subscriber arranges to cancel automatic withdrawal from the credit card numberon file with SPU. Once payment has been received, cancellation is not allowed. To cancel, please contact admin@samsworlduniversity.com
DELIVERYPOLICY/SHIPPING POLICY
CDs and DVDs will be shipped via USPS within 14 business days of receipt of payment.
